1. The website www.brainring.co.uk is owned by Brain Ring Ltd, with a legal entity code of 11768292, and a correspondence address of 129 Tyrrell Avenue, DA16 2BT, London, United Kingdom. This document constitutes a contract between Brain Ring Ltd (hereinafter referred to as the 'Service Provider') and you (hereinafter referred to as the 'Client') regarding the use of the website www.brainring.co.uk (hereinafter referred to as the 'Site').

2. By using the Site, you acknowledge that you have read and agree to all the terms and conditions of this agreement (hereinafter referred to as the "Rules"), and you agree to comply with the Rules.

3. The Rules must be followed by the Client and include any actions taken by the Client on the Site. The Client who uses the Site in any way and form is required to comply with all the requirements of these Rules. If the Client disagrees with the obligations contained in these Rules, they have no right to use the Site.

4. The Rules may be amended at any time, and users of the Site and third parties will be notified on the Site. The amended Rules come into effect after they are announced on the Site.

5. Every individual and legal entity in the United Kingdom can use the website www.brainring.co.uk and the services provided by it.

Provision of Services and Their Use

8. The website www.brainring.co.uk provides services for organizing and conducting educational contests "Brain Ring", as well as related services (hereinafter referred to as "Services").

9. The service provider has the right to fully or partially suspend the provision of the Services. The use of the Services on the website means that you agree to receive informational messages about the activities of www.brainring.co.uk through mailings, SMS messages, email, and other methods.

10. The service provider is not responsible for any disruptions to the provision of the Services on the website, such as problems related to communication, the internet, or any kind of computer piracy or damage from viruses.

11. The client is obligated to use the Services on the website without violating the rules and conditions of the website, as well as the requirements set forth in the legislation of the United Kingdom. Clients of the website undertake not to participate in any other activities that may result in a violation of the provision of the Services.

Rights and Obligations of the Customer

12. The Customer undertakes to:

13.1. provide truthful and detailed information about themselves, including their correct surname, first name, patronymic, email address, phone number, address, and the name of the educational institution;

13.2. not use the Website and/or Website Services for unlawful acts or fraud;

13.3. ensure that the information provided about themselves (hereinafter referred to as "Customer Information") is not misleading and is truthful;

13.4. not collect, compile, download copies of information onto other media, make information publicly available, publish, or distribute data of Website visitors or information about any actions of Website visitors;

13.5. protect their username (email address) and password so that this information cannot be accessed by third parties;

13.6. immediately inform the Service Provider about any changes to the information provided by the Customer (especially when registering on the Website) and/or changes to the information entered in the form on the Website;

13.7. immediately notify the service provider by email [email protected] if the account data and/or password become known to third parties;

13.8. promptly transfer funds for participation in the contest;

13.9. organise the participation of students until the end of the contest;

13.10. provide students who have paid to participate in the contest with passwords for connecting to the system and explain how to connect to the Website;

13.11. ensure fair participation of students in the contest;

13.12. immediately inform the Service Provider if a technical problem is identified.

14. By using any Service, the Customer confirms that:

14.1. they are a physical or legal person of the UK;

14.2. they can and will fully perform their obligations specified in the Rules;

14.3. they understand and agree that by agreeing to these Rules, legal relations are formed between the Customer and the company Brain Ring Ltd, which are directly and explicitly indicated in these Rules;

14.4. understands and agrees that if the account and password necessary for access to the Site become known to third parties, those third parties may assume obligations that will become mandatory for the Client. Brain Ring Ltd, on its part, accepts no responsibility for verifying the Client's identity, except for the data of the account and password.

14.5. understands and agrees that Brain Ring Ltd has the right to process and manage the Client's personal data in accordance with the legislation of the United Kingdom, as well as these Terms of Use and Privacy Policy.

Rights and obligations of the Service Provider

15. The Service Provider has the right, at its own discretion, to restrict or cancel the right to use the Website, including changing any information provided by the Client, as well as canceling the Client's account and prohibiting them from re-registering on the Website. These measures are taken if the Client:

15.1. violates the Rules or fails to fulfill their obligations established by the current Rules;

15.2. provides false, incomplete, or misleading information during registration or while using the Website;

15.3. intentionally or knowingly disseminates false or misleading information on the Website, insults other people, or behaves improperly in the opinion of Brain Ring Ltd.

16. The service provider has the right (but not the obligation) to monitor the actions of the Client on the Site at any time. With legal measures, it also has the right to initiate an investigation of all violations of the Rules.

17. The parties agree that the service provider has the right to terminate the operation of the Site at any time without prior notice.

18. The Service Provider has the right to remove any information provided by the Client from the Website at any time if, in the Service Provider's opinion, it violates these Rules, applicable laws, or moral norms.

19. The Service Provider has the right to change or modify the information provided by the Client on the Website at any time at its own discretion to make the Website more convenient to use.

Consequences of violating the rules

20. The service provider may block, delete, or modify the information provided by the client on the website if it is misleading or untrue, does not correspond to reality, violates the rules or the legislation of the United Kingdom. Misleading information may be edited by the service provider.

21. In case of violating the rules or legislation, the service provider reserves the right to suspend access to the website or the services provided without prior warning.

Provision of personal data

22. Personal data of clients are collected, processed, and provided in accordance with the requirements of the legislation of the United Kingdom and the terms of the website's privacy policy.

Intellectual Property

23. The service provider is the owner of all rights to the content of the Site and has the exclusive right to use it.

24. The service provider has no obligations to pay royalties or other payments related to the use of the content provided by the Client or information published about them when using information about Clients, third parties and/or their content.

Responsibility

26. The client agrees that the service provider shall not be liable and shall not assume any responsibility for the website and/or the malfunction of the services provided, as well as for any loss or damage caused by the client or third parties, and not due to the service provider's failure to fulfill their obligations.

27. The client understands and agrees that the website and/or the services provided by the website are provided without any additional agreements or warranties regarding timely, uninterrupted, quality operation of the website and proper and necessary provision of the website's services, as well as possible negative consequences for the client or third parties. The service provider shall not be liable for information contained on the website that may be unlawful, inaccurate or erroneous (except for information provided by the service provider themselves), particularly for any negative consequences for the client or third parties.

28. The service provider shall not be liable for any damage or loss incurred by the client or third parties while using the website and/or the provided services.

29. The client undertakes to guarantee that the service provider shall never assume any legal liability, payment obligations, reimbursement or compensation obligations for any damages, losses or other expenses incurred in connection with the use of the website and/or the provided services.

Legal disputes

30. The website www.brainring.co.uk is governed by the current legislation of the United Kingdom. In case of any disputes that are not resolved by peaceful means, they shall be resolved in the courts of the United Kingdom, at the place of registration of Brain Ring Ltd, in accordance with the legislation and legal acts of the United Kingdom.
